Single User License Grant: Pulsar Modular and its suppliers grant to Customer ("Customer") a nonexclusive and nontransferable license to use the Pulsar Modular software ("Software") in object code form on the number of computers stated on Customer's license, owned or leased by Customer.

ONLINE ACTIVATION. The Software must be activated before it can be used. Activation needs an internet connection.

(a) What activation sends. When Customer activates the Software, the Software sends to the Pulsar Modular license server: the license key; the product code and version; the operating system family (macOS, Windows or Linux); a name for the computer, which is the computer's own name unless Customer changes it; and two codes that identify the computer. These two codes are one-way hashes. They are made from the computer's hardware ID and installation ID. The hardware ID itself, the user name and the computer's network name are never sent. The server also sees the internet address of each request, as every web server does.

(b) What is stored. The server stores each activated computer as a "seat": the two codes, the computer name, the operating system family and the time of last contact. The two codes are deleted ninety (90) days after the seat ends. The computer name is deleted with the seat. The license server does not store Customer's e-mail address with a seat.

(c) Number of computers. Customer may activate the Software on as many computers at the same time as Customer's license allows. The number is shown on Customer's order and in Customer's account on pulsarmodular.com. One activation covers every format of the Software (for example VST3, AU and AAX) on one computer.

(d) Moving a license. To move the Software to another computer, Customer deactivates it on the old computer from inside the Software, then activates it on the new computer. If the old computer is lost or broken, Customer can release its seat from the My Account page on pulsarmodular.com, or ask Pulsar Modular support to release it.

(e) Working offline. After activation, the Software checks the license in the background while it is running and the computer is online. Each successful check lets the Software work for up to fourteen (14) days without an internet connection. If the computer stays offline longer than that, the Software stops processing audio until the computer connects to the internet again. It then continues without a new activation.

(f) Server not reachable. If the license server cannot be reached, for example because of a network fault or maintenance, the Software keeps working for the remainder of its current offline period described in (e). The Software tries again automatically. Customer does not need to do anything.

(g) Hardware changes. If Customer changes the hardware of an activated computer, the Software keeps working for up to three (3) days and asks the server to move the seat to the changed computer. The number of such moves can be limited to prevent misuse.

(h) Customer must not try to get around, disable or copy the activation, and must not share a license key with other people.

Customer may make one (1) archival copy of the Software provided Customer affixes to such copy all copyright, confidentiality, and proprietary notices that appear on the original.

EXCEPT AS EXPRESSLY AUTHORIZED ABOVE, CUSTOMER SHALL NOT: COPY, IN WHOLE OR IN PART, SOFTWARE OR DOCUMENTATION; MODIFY THE SOFTWARE; REVERSE COMPILE OR REVERSE ASSEMBLE ALL OR ANY PORTION OF THE SOFTWARE; OR RENT, LEASE, DISTRIBUTE, SELL, OR CREATE DERIVATIVE WORKS OF THE SOFTWARE.

The Customer agrees that aspects of the licensed materials, including the specific design and structure of individual programs, constitute trade secrets and/or copyrighted material of Pulsar Modular. Customer agrees not to disclose, provide, or otherwise make available such trade secrets or copyrighted material in any form to any third party without the prior written consent of Pulsar Modular. The customer agrees to implement reasonable security measures to protect such trade secrets and copyrighted material. Title to Software and documentation shall remain solely with Pulsar Modular.

LIMITED WARRANTY. Pulsar Modular warrants that for a period of ninety (90) days from the date of purchase: the Software substantially conforms to its published specifications. Except for the foregoing, the Software is provided AS IS. This limited warranty extends only to Customer as the original licensee. Customer's exclusive remedy and the entire liability of Pulsar Modular and its suppliers under this limited warranty will be, at Pulsar Modular's option, repair, replacement, or refund of the Software if reported to the party supplying the Software to Customer. In no event does Pulsar Modular warrant that the Software is error free or that Customer will be able to operate the Software without problems or interruptions.

This warranty does not apply if the software (a) has been altered, except by Pulsar Modular, (b) has not been installed, operated, or maintained in accordance with instructions supplied by Pulsar Modular, (c) has been subjected to misuse, negligence, or accident, or (d) is used in ultrahazardous activities.

DISCLAIMER. EXCEPT AS SPECIFIED IN THIS WARRANTY, ALL EXPRESS OR IMPLIED CONDITIONS, REPRESENTATIONS, AND WARRANTIES INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON INFRINGEMENT OR ARISING FROM A COURSE OF DEALING, USAGE, OR TRADE PRACTICE, ARE HEREBY EXCLUDED TO THE EXTENT ALLOWED BY APPLICABLE LAW.

IN NO EVENT WILL PULSAR MODULAR OR ITS SUPPLIERS BE LIABLE FOR ANY LOST REVENUE, PROFIT, OR DATA, OR FOR SPECIAL, INDIRECT, CONSEQUENTIAL, INCIDENTAL, OR PUNITIVE DAMAGES HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF LIABILITY ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, INCLUDING ANY PERIOD IN WHICH THE SOFTWARE CANNOT BE ACTIVATED OR CHECKED ONLINE, EVEN IF PULSAR MODULAR OR ITS SUPPLIERS HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. In no event shall Pulsar Modular's or its suppliers' liability to Customer, whether in contract, tort (including negligence), or otherwise, exceed the price paid by Customer. The foregoing limitations shall apply even if the above-stated warranty fails of its essential purpose. SOME STATES DO NOT ALLOW LIMITATION OR EXCLUSION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES.

The above warranty DOES NOT apply to any beta software, any software made available for testing or demonstration purposes, any temporary software modules or any software for which Pulsar Modular does not receive a license fee. All such software products are provided AS IS without any warranty whatsoever. A demo license works for the number of days stated when it is issued and then stops.

This License is effective until terminated. The customer may terminate this License at any time by deactivating and destroying all copies of Software including any documentation. This License will terminate immediately without notice from Pulsar Modular if Customer fails to comply with any provision of this License; Pulsar Modular may then revoke the license key, and the Software stops working at the end of its current offline period. A license key refunded or charged back is revoked in the same way. Upon termination, Customer must destroy all copies of Software.

Software, including technical data, is subject to the export control laws of the Sultanate of Oman and its associated regulations, and may be subject to export or import regulations in other countries. Customer agrees to comply strictly with all such regulations and acknowledges that it has the responsibility to obtain licenses to export, re-export, or import Software.

This License shall be governed by and construed in accordance with the laws of the Sultanate of Oman, as if performed wholly within the country and without giving effect to the principles of conflict of law. If any portion thereof is found to be void or unenforceable, the remaining provisions of this License shall remain in full force and effect. This License constitutes the entire License between the parties with respect to the use of the Software.
